The owner is advertising that they will eventually re-open part of the gym. I want my unused money back but the owner has not returned my faxes or phone calls. What should I do

Read your contract. My gym contract specifies what would happen if the gym is unable to abide by their side of the contract (like if it burned down). You could try to send a letter requesting your money back to the address (certified), chances are he has a post office box or fowarding address on file so he still receives his mail. You could also try the Better Business Bureau and file a complaint if you don’t get any responses from the letter.

    You’ll need to check your contract for the rules regarding refunds. It’s possible the contract states that if the club reopens within a certain amount of time, that your membership continues and then you wouldn’t be eligible for a refund. If not, you can probably sue, but if the club goes into bankruptcy you won’t get much, if anything.
